Age Verification Policy
Last updated: March 1, 2026
Purpose
This Age Verification Policy (“Policy”) sets out the measures we will implement to restrict access to our platform to adults only. Although our platform features exclusively computer-generated (AI) adult content with no human performers, we recognize that that content is legally restricted in many jurisdictions. We therefore apply age-verification controls that meet or exceed applicable laws, regulatory guidance, and payment-processor requirements.
Minimum Age Requirement
You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction (whichever is higher), to access or use Kyssy. By accessing or using the platform, you represent and warrant that:
- You are at least 18 years old or have reached the age of majority in your jurisdiction, whichever is greater.
- You are legally permitted to view adult content in your jurisdiction.
- You will not permit any minor to access the platform through your account or device.
- You accept full responsibility for ensuring that no minor gains access through any device or account you control.
Verification Measures
General Measures (Global)
We apply the following baseline measures to all users worldwide:
- Warning Page: Before accessing the platform for the first time, every visitor is presented with a prominent warning page stating that the site contains AI-generated adult content, that users must be at least 18 years of age (or the age of majority, whichever is higher), and that by proceeding they confirm they meet the minimum age requirement and are legally permitted to view such content.
- Self-Declaration / Age Gate: Users must affirmatively confirm they meet the minimum age requirement before proceeding past the warning page.
- Account Registration: Users must create an account and provide a valid date of birth. Accounts indicating an age below 18 (or the applicable age of majority) are automatically rejected.
- Payment-Card Verification: Access to paid content or subscriptions requires a valid credit or debit card from a recognized payment processor. Because card issuers require the cardholder to be at least 18, this serves as an additional age signal.
- Behavioral and Technical Signals: We may use automated systems to detect patterns consistent with underage use and may require additional verification if suspicious activity is detected.
Note about Warning Page: The warning page is displayed before any adult content is visible and cannot be bypassed without affirmatively confirming age eligibility. The warning page is designed to be clear, prominent, and unambiguous.
Third-Party Verification Providers
Where required by law or where we determine it is appropriate, we integrate with reputable third-party age verification providers. These providers may use one or more of the following methods:
- Government-issued photo ID verification (driver’s license, passport, national ID card).
- Facial age estimation technology that analyzes a selfie or live image to estimate whether the user meets the minimum age requirement.
- Database checks against credit bureaus, electoral rolls, mobile-operator records, or other authoritative data sources.
- Digital identity wallets or verified digital credentials (e.g., eIDAS-compliant digital identity schemes in the EU).
- Open banking or credit-card verification where the payment provider confirms the account holder’s age.
All third-party providers are selected based on their compliance with applicable privacy laws, accuracy of results, and ability to minimize the collection and retention of personal data.
Jurisdiction-Specific Measures
United States
Several U.S. states have enacted laws requiring age verification for access to websites that contain a substantial proportion of adult content. Where such laws apply, we implement age verification measures that comply with the applicable state requirements. These may include government-issued ID verification, third-party age estimation, or other methods approved or accepted under the relevant state statute.
In jurisdictions where age verification laws impose requirements that we determine cannot be met in a manner consistent with user privacy and security, we may restrict access from those jurisdictions.
United Kingdom / Online Safety Act 2023
Under the UK Online Safety Act 2023, services that publish or allow user-generated pornographic content must implement “highly effective” age assurance measures to prevent children from accessing that content. In compliance with this requirement:
- We implement age verification for all UK-based users before any adult content is accessible.
- We use methods that Ofcom considers to be highly effective, such as photo ID verification, facial age estimation, or open banking checks.
- We ensure that the age assurance method used is privacy-preserving, proportionate, and in line with Ofcom’s published guidance and codes of practice.
- We regularly review Ofcom’s updated guidance to ensure ongoing compliance.
European Union
EU member states may impose age verification requirements under national law, the Digital Services Act (DSA), or the Audiovisual Media Services Directive (AVMSD). We comply with applicable EU requirements and implement age verification measures consistent with the laws of the member state from which the user accesses the platform. Where the EU or a member state mandates specific verification methods or standards, we adopt those methods or recognized equivalents.
Other Jurisdictions
We monitor legislative and regulatory developments globally and will implement additional or enhanced age verification measures as required by the laws of other jurisdictions. If you access the platform from a jurisdiction with specific age verification requirements, those requirements apply in addition to our baseline measures described above.
Payment Processor & Industry Compliance
We maintain compliance with the requirements of our payment processors and card networks regarding age verification. This includes:
- Ensuring that all users who make purchases or subscribe to paid services have been verified as meeting the minimum age requirement.
- Complying with Visa, Mastercard, and other card network rules concerning age-restricted content.
- Responding promptly to any inquiries or audits from payment processors regarding our age verification practices.
- Implementing any additional controls requested by payment processors to maintain our merchant account in good standing.
Privacy, Data Minimization, and Retention
We are committed to protecting user privacy throughout the age verification process. Our approach includes:
- Data Minimization: We collect only the information strictly necessary to verify age. Where possible, we use methods that confirm age without requiring us to store identity documents or biometric data.
- Third-Party Processing: Where third-party verification providers are used, the provider processes identity data directly and returns only a pass/fail result (or equivalent) to us. We do not receive, store, or have access to the underlying identity documents or biometric data held by the provider.
- Retention Limits: Any personal data collected solely for age verification purposes is retained only for as long as necessary to fulfill the verification, comply with legal obligations, or resolve disputes, and is then securely deleted.
- Security: All data transmitted during the age verification process is encrypted in transit (TLS 1.2 or higher) and at rest. Access to verification data is restricted to authorized personnel on a need-to-know basis.
- Privacy Policy: Full details about how we collect, use, store, and share personal data, including data processed during age verification, are set out in our Privacy Policy.
Attempts to Circumvent Age Verification
We take a strict approach to any attempts to circumvent or undermine our age verification controls. This includes:
- Using VPNs, proxies, or other tools to misrepresent your location in order to avoid jurisdiction-specific age verification requirements.
- Providing false, misleading, or fraudulent information (including a false date of birth) during registration or verification.
- Using another person’s identity documents, payment credentials, or verification results to gain access.
- Sharing account credentials with minors or otherwise facilitating a minor’s access to the platform.
If we detect or reasonably suspect any attempt to circumvent age verification, we may immediately suspend or terminate the user’s account, restrict access, report the conduct to relevant authorities, and pursue any other remedies available to us under our Terms of Service or applicable law.
Updates and Compliance Monitoring
We regularly review and update this Policy and our age verification measures to ensure they remain effective and compliant with evolving legal requirements, regulatory guidance, and industry standards. We monitor developments in age verification technology and will adopt improved or additional methods as they become available and appropriate.
